THE ORISSA STATE WATER AND SANITATION MISSION

Drinking water supply programme is being implemented with the assistance from Government of India. In 1972, Govt. of India introduced Accelerated Rural Water Supply Programme (ARWSP). Minimum Need Programme(MNP) is the State matching component for the above. Despite an impressive coverage, the programme was continued to 9th five-year plan due to reemergence of problem habitation and lack of sustainability of sources as also water quality problem. The current situation is that, the State has achieved coverage of more than 99% of its habitations.  However, in spite of this impressive performance, use of safe drinking water in rural households is required to be improved further through greater sustainability of the sources and awareness of the people.

Recognizing the imperatives for a change from target based, supply driven approach to demand driven approach, Government of India have initiated a community oriented programme of Sector Reforms in Water Supply and Sanitation. This programme is being implemented in three pilot districts of the State i.e. Ganjam, Balasore and   Sundargarh to be funded by Govt. of India. Some of the major highlights of Sector Reforms are as follows:

Ø                   Shift from Supply to Demand Driven approach.

Ø                   Stress on social mobilisation to ensure sustainability.

Ø                  Ensuring community participation with contribution of user charges for the operation and maintenance by them.

Ø                   Establishing inter sectoral linkages

Ø                   Ensuring transfer of all existing and new Rural Piped Water Supply projects to Users’ Associations for maintenance and operation.

 

With this approach for the Water Supply and Sanitation Programmes, it was felt that creation of a State Level Water Supply & Sanitation Mission with necessary operational flexibility in line with Rajiv Gandhi National Drinking Water Mission (RGNDWM) set up by Govt. of India would be more effective in making the new initiative successful. Accordingly Govt. Resolution No. 9990/RD dt. 5.7.2002 was issued for establishment of Orissa State Water & Sanitation Mission.

             “Orissa State Water & Sanitation Mission” (OSW&SM) referred as “State Mission has been constituted and established in R.D. Department resolution No.9990 dt.5.7.2002 and registered itself under Society Registration Act 1860 on 14.8.2002         for providing overall policy guidance for community led and participatory WATSAN projects.

The area of operation of the society shall extend to the whole of Orissa State.

Aims & Objectives of the Mission:-The Mission shall have the overall goal to improve the quality of life by enhancing access to better water supply & sanitation facilities in the rural areas ensuring sustainability. The Mission will be responsible for the following action points.

(i)                  To promote community ownership of the projects with the responsibility for operation and maintenance in order to ensure sustainability.

(ii)                 Overall policy guidance and coordination of programmes implemented by the District Water & Sanitation Missions keeping in view the guidelines of Govt. of India & Govt. of Orissa for water and sanitation programmes in order to make the water supply projects self-sustainable.

(iii)               To ensure transfer of all existing and new Rural Piped Water Supply projects to the Users’ Association.

(iv)               To ensure coordination with different departments, agencies and convergence of different activities related to water supply and sanitation in rural areas.

(v)                To take any other activities that are consistent with the aims & objectives of the Mission.

 Rules and Regulations

 1. Short title and commencement

(a)                The rules and regulations be called the Rules of Orissa State Water & Sanitation Mission.

(b)                These rules shall come into force from the date on which the Society, namely Orissa State Water & Sanitation Mission is registered under the Societies Registration Act, 1860.

2. The registered office of the society shall be at Bhubaneswar.

3. Governing Body. The governing body of the Orissa State Water & Sanitation Mission shall be constituted as such under the regulation of the society.

5. Membership

 

(i)                  The Official members will hold office as ex-officio members.

(ii)                 The non-official members will hold office in the Mission as members for a period of 3 (three) years.

6. Termination of Ex-Officio Membership

Where a person becomes a Member of the State Mission by virtue of the office or appointment, which he/she holds, his/her Membership of the State Mission shall stand terminated when he/she ceases to hold that office or appointment.

7. Termination of membership of others.

Membership of other than ex-officio Members, shall stand terminated on the happening of any of the following events:-

(i)                   On the expiry of the period of Membership for which nominated;

            (ii)                 Death, resignation, insolvency, lunacy or conviction for a criminal offence involving moral turpitude;

(iii)                When a Member does not attend three- consecutive meetings without proper leave of absence.

 

8. Power/ Functions of the office bearers:

 

A.  Chairman & Vice-Chairman

 

(i)                  The Chairman will preside over all meetings of Governing Body and in his/her absence the Vice-Chairman will preside.

(ii)                 For Executive Body, the Chairman and in his/her absence the member Secretary will preside over the meetings.

(iii)               The Vice-Chairman, Member Secretary and all members will have the right to attend all Governing Body/ Executive Body meeting.

 

B.       Member Secretary

(i)                  All executive and financial power of the mission shall vest on the Member Secretary who shall be responsible for the planning; implementation and monitoring of activities as would be guided and decided by the mission.

(ii)                 Will exercise and discharge such duties as may be delegated to the Secretary by the Mission.

9. Power & function of the Mission:

 

A.     Governing Body

 

(i)                  Overall policy guidance & coordination of programmes implemented by the District WATSAN missions.

(ii)                 To ensure coordination with various departments, agencies and convergence of different activities related to water supply & sanitation in rural areas.

(iii)               To approve & sanction the Annual Plan & Budget.

(iv)               Make, alter and revise the rules and regulations of the mission.

(v)                Delegate powers & function to the employees of the mission.

B.      Executive Body

 (i)                  Implement the policies/decision of the Governing Body.

(ii)                 Interact with GOI/RGNDW.M and support the implementation of or directly implement, various Rural Water Supply and Sanitation schemes and other related activities as well as programmes funded by external donors like DFID, UNICEF, DANIDA etc.

(iii)               Liaise & Co-ordinate with various line departments, State Govt. & other sector partners and ensuring participation of the SHGs and the communities in different projects.

(iv)               Identify, mobilise NGO’s to undertake work as per schemes notified by the Department of Rural Development. This would include providing technical assistance, guidance and training.

(v)                Ensure establishment of Missions in the District Level and Panchayat Level.

(vi)               Ensure opening of separate Bank account at District Level and Panchayat Level.

(vii)             Organise meeting/Workshop/Study tours/Seminars with involvement of all concerned prepare IEC/ Publicity materials for Sanitation and Sector reforms projects and other related activities.

(viii)            To promote adoption of demand driven & participatory approach, service delivery maximizing empowerment of villagers in decision making on the choice of service levels.

(ix)               Monitor and evaluate the implementation of the schemes by the various agencies including NGO’s.

(x)                Consider and approve the annual accounts ensuring proper auditing of the expenditure by competent authority.

(xi)               Undertake any other activities that are consistent with the aims & objectives of the Mission.

 Meeting of the Mission

 (i)                  The Governing Body/ Executive Body of the Mission shall meet as often as may be considered necessary for the transaction of the business of the mission, provided that the Governing Body shall meet at least once in 6 (six) months and Executive Body shall meet at least once in 3(three) months.

(ii)                 The meeting of the Mission shall be held at such date and time as may be fixed by the Member Secretary in consultation with the Chairman/ Vice Chairman.

 (iii)               At least one week notice shall be given for convening a meeting. An extra ordinary meeting may, however, be called at a shorter notice.

 (iv)               The Chairman and in his absence the Vice-Chairman for the Governing Body or the Member Secretary for the Executive Body will preside over every meeting of the Mission.

 (v)                All decisions will be taken by majority vote of members present and voting.

 12. Emergency Power of the Chairman, Vice-Chairman & Member Secretary

 Nothing in these rules & regulations shall prevent the Chairman/ Vice-Chairman and Member Secretary from exercising all powers of the Mission in case of emergencies for furtherance of the objectives of the mission and action taken shall be reported to the mission in the next Governing Body & Executive Body.

 13. Proceedings of the meeting:

 (i)                  All business of the mission as far as possible will be recorded as proceeding of the mission.

(ii)                 All disputed questions shall be determined by majority votes. Each member shall have one vote and in case of equality of votes the Chairman shall have a second casting vote.

 (iii)               The proceedings of the meeting of the mission shall be circulated to all members.

 14.  Remuneration of Chairman and Members

The Chairman or any official member of the Mission shall not be entitled to any allowance or other remuneration. The non-official members will be reimbursed the TA and DA cost as may be approved by the mission.

15.  Funds of the Mission and Accounts

 The fund of the mission shall consist of following

 (i)                  Grants made by or through Govt. of India or State Govt.

(ii)         All money received by way of grants, transfer or in any other manner form any source other than the source of Govt.

16.  Budget

 The Annual Budget will show the estimated receipts and expenditure and shall be prepared in such form as may be prescribed by the Govt. and submitted in such manner as may be required.

 17.  Management of Fund.

(i)                   All money credited to the funds of the mission shall be deposited in a Nationalised Bank. All withdrawals from funds shall be made by cheques. All cheques shall be signed by two signatories Chair/Vice-Chairman and the member secretary or any other designated authority as would be decided by the mission.

(ii)                 The mission by Resolution may decide the percentage of contribution to be realised towards establishment and miscellaneous expenditure of the mission.

 18.  Accounts and Audit

(i)                   The Accounts of the Mission shall be maintained in double entry book keeping system and in the format prescribed according to the directions issued by the Government of India with the following minimum books of accounts & records.

(i)     Cash Book

(ii)    Journal

(iii)  Vouchers

(iv)  Bank ledger

(v)   Bank Draft/ Cheque receipt register

(vi)  Cheque issue register

(vii)Any other register as would be prescribed by mission.

(ii)                 The Accounts of the mission shall be audited by a Chartered Accountant or any other qualified person or agency who shall be appointed by Govt. of India/ State Govt. in Rural Development Department .

(iii)                A monthly account showing the allotment and expenditure under each item shall be prepared and submitted to Govt. of India. At the close of each quarter, a consolidated account showing the total receipts, payments during the period under several heads of account with opening & closing balances shall be prepared and submitted to Govt. of India. The Member Secretary shall present the Annual Accounts of the Mission by a date not later than 20th June of every year comprising receipt & payment accounts and balance sheets.

(iv)               A copy of such audit report duly signed by the Auditor and Chairman or Vice-Chairman and Member Secretary of the Mission shall be furnished to the Govt. of India not later than 30th June of every year.

(v)                 The Comptroller and Auditor General of India shall have the same rights, privileges and authority to conduct audit of the accounts of the Mission as he has in connection with the audit of the Govt. accounts and for this purpose shall have the right to demand the production of books of accounts and other relevant records of the mission.

19.  Assets

(i)                   A Statement showing the inventory of fixed assets held by the Mission at the end of each financial year shall be sent to Govt. of India and Government of Orissa along with the annual statement of accounts. No depreciation shall be charged and the value of the assets will be shown at the original cost with accounts.

(ii)                 Separate utilisation certificate in respect of grant received from the Govt. of India and other sources for different programme shall be sent to the Ministry, R.D.Deptt, RGNDWM and programme officers of respective donor agencies, along with audited statement of accounts.

20.  Authentication

All orders and decision of the mission shall be authenticated by the signature of the Chairman/Vice- Chairman and all other papers/ documents shall be authenticated by the signature of the Member Secretary.

21.  Directions of Central / State Government.

The Mission shall carry out such directions as may be issued to it from time to time by the Government of India or State Government. It shall furnish to the Govt. of India or the State Govt. such reports, returns and other information as may be required by them from time to time.

22.  General/ Legal Action.

(i)                   The mission may sue or may be sued in the name of the Member Secretary.

(ii)                 The income & property of the mission derived, shall be applied towards the promotion of the objectives there-of, subject nevertheless to financial discipline in respects of the expenditure of grants imposed by the Central Government from time to time.

(iii)                No portion of the income and property of the mission shall be paid or transferred directly and indirectly by way of dividend, bonus or otherwise to any person or organisation who at any time was or has been Member of the mission.

(iv)               In the event of winding up or dissolution of the mission and after satisfactory setting of its liabilities, all remaining assets shall not be paid to or distributed among with the Members or any of them but shall be disposed in such manner as the Central/ State Govt. may determine.

23.  Staffing Pattern.

The Mission can appoint staffs on deputation from Govt./ State Govt. undertakings or appoint professionals on contractual terms depending on the requirement & availability of funds under different schemes with concurrence of Finance Department and prior approval of Government. Selection will be made through open advertisement.

24.  Amendment to the Rules & Regulation

The rules and regulation of the Mission shall be amended by the Governing Body with prior approval of the Govt.

25.  External Evaluation

The State Govt. may conduct external evaluation of the Mission performance as & when felt necessary through such agencies as deemed appropriate.
