CAPITAL ADMINISTRATION -II & IV(LAND BRANCH):
The Orissa Public Premises (eviction of unauthorized occupants) Act, 1972 and Orissa Public Premises (eviction of unauthorized occupants) Rules, 1988 is the main act and rules used by Estate court.
CHIEF MINISTER’S RELIEF FUND(CMRF):
Assistance from the C.M.R.F. is regulated as per provision of Guide lines formulated by the CMRF Trust Board in it's meeting held on 14.09.2000.
The Guide lines are reproduced below :
C.M.R.F. GUIDELINES FOR FINANCIAL ASSISTANCE
1.1 Only application of indigent persons with annual income of less than Rs.18,000/- in rural areas and less than Rs.24,000/- for urban areas will be considered.
1.2 The assistance will mainly be for major ailments like cancer, cardiac surgery & renal transplant etc. and not for common ailments like T.B., eye operation, ulcer treatment, burn injuries etc. In case of doubt about the ailment’s nature, the Secretariat Doctor will be consulted by Deputy Secretary (C.M.R.F.) once every week.
1.3 Assistance will normally not be provided where medical coverage under ESI, CGHS or any other scheme is available or where there is a provision for reimbursement of the cost of medicines.
1.4 Any person shall be assisted only once in a financial year and not more than three times during his/her lifetime if treatment is required for a different ailment.
1.5 Normally where the medical facilities for treatment are available within the State, assistance will not be provided for treatment out side the State.
1.6 The assistance will not be available for reimbursing the expenditure incurred by the applicant. The date of application should be prior to the treatment and not later.
1.7 No financial assistance from Chief Minister’s Relief Fund will be available for purposes like study, marriage, thread ceremony or other social purposes.
2. The quantum of assistance-The assistance sanctioned will be limited to 1/3 rd of the estimated cost subject to a maximum of Rs.15,000/-.
3.1 Special Secretary, G.A.Deptt. will be authorised to sanctioned assistance up to Rs.15,000/- subject to norms. All such cases of sanction will be placed for post-facto approval of the Trust and the Chief Minister.
3.2 All rejections if recommended referred from the office of the Chief Minister will be placed before the Chief Minister for information.
3.3 All cases where relaxation of norms is involved, prior approval of the Chief Minister will be necessary.
4. Assistance exceeding Rs.5,000/- should be released through the concerned hospital on receipt of information regarding date of admission. However, if the person is discharged from hospital, the sanctioned amount shall be released through Collector of the District on production of certificates relating to treatment and discharge.
5. The applicant will be intimated about the sanction of assistance within seven days after sanction. The sanction will remain in force for six months. If no intimation is received within the time schedule, the sanction will stand cancelled.
6. In case of the death of the applicants or the person in whose favour the assistance was sought, the financial assistance sanctioned will be released to the persons available first in the order indicated below: 1). Spouse 2).Children(Including step children) 3). Parents 4). Widowed Daughter and 5). Sisters. Where the deceased was a minor, the money will be paid to the mother, the father or the legal guardian in that order of availability.
7. Before making such a release, a report will be sought from the Collector of the District where the applicant/person seeking assistance was ordinarily residing.
8. Persons affected by the accidents/fire/natural calamities where assistance under Orissa Relief Code is available will not ordinarily be assisted. However, where such incidents are devastating in nature, the cases will be placed before the Chief Minister.
9. The Chief Minister may relax any or all of the criteria in exceptional cases justifying extreme compassion.
