PROCEEDINGS OF THE TRIBES ADVISORY COUNCIL MEETING

HELD ON  29.7.2006

          The meeting of the Tribes Advisory Council was held on 29.07.2006 at 10.30 AM in the 3rd Floor Conference hall of the Secretariat. Hon'ble Chief Minister, Orissa presided over the meeting. The list of Hon'ble Members and other officers who attended the meeting is given at Annexure-1.

                 In the beginning,  silence for two minutes was observed in memory of late Sri Gajadhar Majhi, MLA Talasara and Hon'ble Member of the TAC, who passed away on 20.05.2006.

                 The Minister, ST & SC Development & Minorities & Backward Classes Welfare welcomed all the members to the TAC and informed them about various developmental programmes being implemented for all round development of Scheduled Tribes. He also appealed to all the Members to extend their whole hearted cooperation in formulating policies to address important issues concerning tribal welfare.

                The Chief Minister, in his welcome address, highlighted the importance being attached to tribal development programmes for securing for them their entitlements in every sphere. He was delighted to inform the members about the Supreme Court decision allowing settlement of pre-1980 habitations classified as forest land, which is expected to settle the long-pending grievance of the tribals. He informed that the Government is particularly concerned about improving the educational infrastructure in tribal areas.  In this regard, establishment of 1000 girls hostels, for providing residential accommodation to a lakh girl students within a period of three years is an important step. He also referred to various poverty alleviation programmes being implemented in the Scheduled Areas, and informed the members that important sectors like rural connectivity, irrigation, development of educational infrastructure, skill upgradation of ST and SC youth through vocational training, increasing agricultural productivity would continue to receive due thrust in all planned development programmes of the Government. The members were also informed about the concern of the State Government for proper rehabilitation and resettlement of families being displaced for various developmental projects in the State.

           The Commissioner-cum-Secretary, ST & SC Development Department  placed the agenda items before the TAC for discussion and decision as follows:

Agenda No. 1

Confirmation of the proceeding of the meeting of the Tribes Advisory Council held on 29.07.2005.

          The proceedings of the meeting of the TAC held on 29.7.2005 were confirmed. It was decided that the meetings of the TAC should invariably be held at least twice in a year as provided in the TAC rules.

Agenda No. 2

Follow up action taken on the proceedings of the meeting of the TAC held on 29.07.2005.

2.1

The Expert Committee headed by Dr. D.P.Patnaik on the use of tribal languages in school curriculum had submitted its interim report on 12.11.2005 to School & Mass Education Department. The report suggested that Santali language should be introduced in Oriya script  in the educational system in primary schools. After examining the report, the Department has decided to initiate steps to impart teaching at primary level in Santali language. Smt Droupadi Murmu suggested that Olchiki script would be more appropriate to catch the nuances of the Santali language. After detailed discussion, it was decided that the School and Mass Education Department would carry out the recommendations of the Expert Committee.  The members expressed their concern as regards other nine languages like Soura, Kuvi, Kui, Bonda, Juang and Koya language. The final report will be submitted after field visit by the Committee. The SPD, OPEPA has already prepared primers in Santali language to impart teaching in concerned primary schools. School and Mass Education Department will take necessary steps in this direction.

2.2

Inclusion of the MURIA/ PAIKA BHUYAN/ PAIK BHUYAN/ PAHARIA (KAMAR) communities in the Constitution (ST) Order

 

            The members expressed concern over the delay at Government of India level as regards inclusion of various communities, i.e. Muria/ Paika Bhuyan/ Paharia (Mamar) etc. in the Constitution ST Order. Hon'ble Chief Minister advised the Department to share full information with the Hon'ble members of Parliament from Orissa so that they could take up this issue during the current session of the Parliament to expedite matters.

2.3

Making suitable amendments in the existing rules for production of “Nativity Certificate” instead of ‘Residential Certificate’ for the purpose of seeking employment against a district cadre post in Scheduled Areas

 

            On the question of making suitable amendments in the existing rules for production of ‘Nativity Certificate’ instead of ‘Residential Certificate’ for the purpose of employment against a district cadre post in Scheduled Areas, the Special Secretary, G.A.Department informed about the constitutional impediments and the views of the Law Department in enacting such a provision in the rules. After detailed discussions, it was decided that a committee of Secretaries should be constituted.  The committee will comprise Principal Secretary, Revenue & Disaster Management, Principal Secretary, Forest & Environment, Principal Secretary, Law and Commissioner-cum-Secretary, ST & SC Development Department. The Committee will devise appropriate criteria a format for issue of Residential Certificate and work out a framework, so as to protect the interest of actual natives of each district in the matter of seeking employment in district cadre posts in tribal areas. The objective is to ensure that the exployees selected to district cadre have roots in the district and are therefore not likely to play truant. Absenteeism at grass root level development and regulatory administration is a serious problem and can be effectively tackled by employment of staff with roots in the district. This exercise should be completed by the Committee of Secretaries within a period of one month.

2.4.3

Settlement of Govt. land with STs in the Scheduled Areas:

          In the matter of settlement of Govt. land with non-STs in Scheduled Areas, the Revenue Deptt. opined that there may not be any need for framing a special rules for allotment of Govt. land in favour of landless STs in Scheduled Areas of the State in view of adequate provisions in the existing OGLS Act. Some of the Hon'ble Members, however, insisted that even though there is provision in the existing Acts and Rules regarding settlement of Govt. land in favour of landless STs in Scheduled Areas, yet Government should make a resolution as per the provisions of para 5(2)(b) of the 5th Schedule to the Constitution of India. It was decided that a new regulation to deal with settlement of Govt. land in the Scheduled Areas should be framed in accordance with the above constitutional provisions, which would safeguard the interest of landless tribals in Scheduled Areas of the State.

2.5

Further amendments to Orissa Transfer of Immovable Properties (by Scheduled Tribes) Regulation 2 of 1956.

The issue of further amendment to the Orissa Transfer of Immovable Properties (by STs) Regulation 2 of 1956 was discussed. Smt. Sumani Jhodia mentioned that there is no need to further relax the land transfer regulation, as any such step would deprive successive generations of tribals of ownership of land. It was decided that the relaxation would be considered cautiously, taking into account  various  viewpoints of concern. The committee comprising Minister, Revenue, Minister, ST & SC Development, Principal Secretary, Revenue & DM and Commissioner-cum-Secretary, ST & SC Development Department will expedite their report by 31.10.2006 for bringing suitable amendments to Regulation 2 of 1956.

2.7

Consideration of the need for non-application (or application with modification) of the provisions of Forest Conservation Act,1980 and Land Acquisition Act, 1894 in respect of Scheduled Areas of Orissa.

          As regards applicability of provisions of Forest Conservation Act, 1980 to the Scheduled Areas of Orissa, the Principal Secretary, Forest & Environment Dept. elaborately explained the position of pending cases in respect of 17 districts in view of the recent Supreme Court order allowing the State Govt. to go ahead with such settlement. The members expressed relief and expected that the Forest Department and Revenue Department would do well to ensure early settlement of cases so that land pattas are issued in favour of the tribal settlers as per the provisions of the Forest Conservation Act and revenue laws. It was also decided that joint verification reports in respect of other districts should be expedited.

2.8

Review of implementation of Panchayats (Extension to Scheduled Areas) Act, 1996.

          The Director, SCSTRTI briefly explained the important findings of the evaluation conducted by the Institute on implementation of PESA Act, 1996. Thereafter, the members made wide ranging discussions on various provisions of the PESA Act covering the activities of several Departments, like –

(i)  (i)  proposal to exclude Mahua flower from the purview of stock holding restrictions under the Excise Law ,

(ii)                (ii) Ensuring that the Gram Panchayats fix the market price of 69 MFPs control over which have been transferred to them ,

(iii)             (iii) educating the GPs to take action against offenders indulging in distress sale of MFPs by tribals and 

(iv)             (iv)   Reservation of ST seats for Zilla Parisads.

 (Action: Excise, Forest and Environment and Panchayati Raj Depts.)

2.15

Posting of regular project Administrators in ITDAs.

          The Special Secretary, G.A.Department assured the members that the vacant posts of Project Administrators in ITDAs would be filled up shortly.

Status of ‘Jhodia’ community:

          While noting that the case of ‘Jhodia’ was referred to Govt. of India for inclusion in the ST list, the Council recommended to take up the matter once again for correction of the mistake.

Evaluation of the working of Protective Legislation (as referred by His Excellency, the Governor of Orissa under Rule-17 of Orissa Tribes Advisory Council Rules)

          The Commissioner-cum-Secretary, ST & SC Development Department apprised the members about the reference made by His Excellency, the Governor of Orissa as per Rule 17 of the TAC Rules for detailed deliberation on the working of different regulations relating to transfer of land by or among the members of Scheduled Tribes, allotment of Govt. land to the STs and regulation of money lending business in the Scheduled Areas of the State.

Effectiveness of Regulation-2 of 1956 as amended by Regulation-1 of 2002 in the    Scheduled Areas of the State.

          The Orissa Scheduled Areas Transfer of Immovable Properties (by Scheduled Tribes) Regulation 2 of 1956, as amended by Regulation-1 of 2002 has brought mixed reaction from different sections of the tribal community.   On the one hand, there is a feeling that the implementation of the Regulation is not very effective in checking clandestine or fraudulent transfer of tribal land to non-tribals in various forms. On the other hand, relatively progressive sections among the community feel it necessary to further relax the provisions so as to allow transfers for certain developmental needs, like higher education, investment in business or industry etc. After discussions in the TAC, it was decided to await the recommendations of the ministerial level committee which is to submit its reports by 31.10.2006. However, the need for evolving an information system on progress of implementation of this regulation was unanimously felt. The Revenue Dept. may develop such an information system to be put in place.                                                (Action: Revenue & DM Dept)

3(b)

Regulating allotment of Government land to the Members of the STs in the Schedule Areas 

          As already stated at Para 2.4.3, the Revenue Department will come up with a special regulation in this regard.            

3(c)

Applicability of the provisions of Forest Conservation Act and Land Acquisition  Act in Scheduled Areas

          The operation of the two Central Acts in the Scheduled Areas of the State was discussed and some members wanted suitable modifications in accordance with the provisions contained in 5th Schedule of the Constitution defining a more effective role for the PRIs in matters relating to acquisition of tribal land and applicability of the provisions of Forest Conservation Act. Hon'ble Chief Minister informed the members about the recent Supreme Court order which permits settlement of pre-1980 forest habitations in respect of 17 districts of the State. Additional proposal in respect of other districts will be sent to Govt. of India after due joint verification. He advised the Secretary, F & E Dept. to expedite matters. It was also felt appropriate to await enactment of Scheduled Tribes (Recognition of Forest Rights Bill, 2005) by Govt. of India.  A detailed review  of joint Forest Management Policy will be made. (Action: Forest Dept)

 

          As regards relevant provisions of the Land Acquisition Act, the Principal Secretary, Revenue Dept. informed the members about Govt. of India efforts to amend the century-old Land Acquisition Act to address various problems of the modern times.

Agenda No. 4

Need for further amendments to Orissa Transfer of Immovable Properties (by Scheduled Tribes) Regulation 2 of 1956.

       As stated at para 2.5, the Committee will furnish report by 31/10/2006.

Agenda No. 5

Review of implementation of Panchayats (Extension to Scheduled Areas) Act, 1996.

 

           The follow up action taken by various Departments to make suitable rules and regulations or to amend the existing acts and rules in conformity with the provisions of PESA Act, 1996 were discussed in detail and the following decisions were taken:

(i)                 Land pass books will be issued to the Scheduled Tribes whether APL or BPLin respect of their homestead and agricultural land free of cost in I.T.D.A. areas. The expenditure towards taking photographs etc. of the members of the Scheduled Tribes will be borne by the ITDAs in TSP areas or other State Govt. agencies.

(ii)               A Committee constituted to suggest modifications required for Regulation 2 of 1956 will submit its report within three months.

(iii)             A special Regulation will be brought on allotment of Govt. land in Schedule Areas.

(iv)             Further amendments to the joint forest management policy will be brought in within three months outlining greater participation of the tribal communities.

(v)               Efforts will be made for skill upgradation, design improvement and marketing of tribal handcrafts linking professional support.

(vi)             Vacancies of teachers in tribal schools will be filled up on priority.

(vii)           Revenue Dept. and Law Dept. may take steps to settle various types of ‘Jagir’ land in the Schedule Areas in favour of village committees or deities instead of giving Pattas in favour of individuals rendering service to the village community/institutions. This was felt necessary in order to keep the tribal culture and traditions intact, as otherwise the individual servitors (Sevayats) may stop giving such service to the community/ institutions.

Agenda No. 6

 

 

Review of implementation of ORV Act, including Special Recruitment Drive to fill up backlog vacancies.

          All the Departments of Govt. are to report in detail about the backlog vacancies in different categories of posts to ST&SC Development Dept. by 15.08.2006.

(i)                 The provisions of 85th constitutional amendment must be implemented by all concerned Departments expeditiously subject to orders of the competent courts from time to time.

(ii)               Government will consider amendment of the ORV Act in conformity with the 81st amendment of the Constitution should be expedited.

 

(iii)             Proposal for filling up backlog vacancies for STs and SCs should be submitted by all the Departments for Finance Dept. clearance.

 (Action: All Departments, Finance Dept.)         

Agenda No. 7

Developmental programme implementation in Scheduled Areas of the State.

 

The progress of implementation of various schemes like SCA to TSP and utilisation of grants under Article 275(1) were discussed. It was emphasized that proper monitoring and review of programme implementation  should be made to ensure timely utilisation of grants and submission of utilisation certificates to Govt. of India in view of the restrictions imposed by promulgation of FRBM Act, 2003. The members expressed concern about the large vacancies of doctors and ANMs in tribal areas. The Health Department would examine the issue of providing that no admission in Post graduate courses would be permitted, if the person has not served in Scheduled Areas as a doctor.

Agenda No. 8

Adoption of single line demand and single line administration in Orissa

 

The provisions and modalities of single line administration of tribal sub-plan funds were discussed in detail. The working difficulties in implementation of the single line demand in respect of Orissa where the tribal population constitute about 1/4th of the State’s population were also discussed in detail. It was unanimously decided to adopt pre-budget scrutiny by involving ST & SC Development Dept. together with Finance and Planning & Coordination Dept. so as to ensure proportionate fund flow to Tribal Sub-Plan. Similarly the utilization of funds will be monitored more closely, to see whether the desired benefits are accruing to the tribal areas. The Development Commissioner-cum-Addl. Chief Secretary was requested to issue suitable instructions to issue all Departments in this regard at the earliest.           (Action: Planning & Coordination Dept.)               

Agenda No. 9

Approval of the Annual Administration Report for the year 2004-05.

       The draft Annual Report on the Administration of Scheduled Areas for 2004-05 received with the observations of His Excellency the Governor of Orissa was placed before the TAC. After discussions, the TAC recommended for approval of the Annual Report on Administration of Scheduled Areas for 2004-05. Regarding the two points observed by the Governor, decisions have been taken as at Para 2.4.3 and para 5(iv) above.

Discussion on R& R Policy, 2006

          The important features of Rehabilitation & Resettlement Policy, 2006 were explained by the Principal Secretary, Revenue Dept. It was reiterated that resettlement and rehabilitation of tribals being displaced due to establishment of  industry or developmental project would precede actual establishment of such industry/ project. The views of the tribal representatives in Rehabilitation and Periphery Development Advisory Committee (RPDAC) and District Compensation Advisory Committee (DCAC) would be given due weightage in chalking out course of action for implementation  of various development projects. Effective functioning of the grievance redressal forums at State level, district level and project level will be ensured through adequate monitoring and supervision.             (Action: Revenue & DM Dept.)
